Tuc**., Dec. 12, 1972 Tlie News-Heralci — 5Toy Company, Motorist Sued for SI MillionA $1 million lawsuit has been filed against Louis Marx St Co. Inc., of New York and a Cleveland motorist. The action was filed Monday in Cuyahoga County Common Pleas Court by attorneys representing 6-vear*old Michael Rupp The suit charged that the youth was riding a “Wild Rider” built bv Marx and that the tov carried him into thewstreet where he was struck by a car. The suit said the toy was negligent in design because it is a free-wheeling vehicle without any steering or control mechanism. The suit said the youth was unconscious for four weeks after the mishap and suffered permanent and disabling injuries” in the accident. The motorist named in the suit was John D. Dessoffy.w
