The sentence was vacated on Dec. 23.Dec. 19.1957 he was charged with escaping jail and sentenced to one to five years to run concurrenth with a life term given for being a habitual criminal.The habitual criminal charge was filed Dec. 19, 1957 following the jail break. The petition Stated March 16, 1948 he was sentenced in Odessa, Texas for theft over $50; charged with assault with intent to rob in Ft. Worth, Texas on Oct. 9, 1952. Dec. 2, 1957, grandlarceny charges filed by Assistant District Attorney Jack Love. Harvey Mark-ley, Lovlngton attorney wasappointed to represent Rinehart.On Dec. 23, 1957, Rinehart was released under Rule 93 after he stated he had not been advised of his constitutional rights at time of arrest.
