Denton County Atty. Rob- j ert H. Caldwell Jr. said this morn- j ing he’s considering filing charges against Ganoe.The murder charge against the 30 - year - old Lumpkins was filed Tuesday morning by Caldwell in Judge Z. D. Payments on the car were allegedly delinquent from October.Malone argued that he wanted the tires off the car. since they were not mortgaged. However. Ganoe got in the car and drove off and Lumpkins drove his own car away, both heading toward Fort Worth.Malone gave pursuit and overtook the pair in Justin. He reportedly stopped the car Ganoe was driving and a scuffle ensued. Lumpkins drove past and then turned his car around and returned to the scene.As Lumpkins stopped his car, Malone reportedly brandished a .45 calibre pistol. Lumpkins then allegedly got a .45 calibre pistol from the glove compartment of his car and fired one shot at Malone, the bullet entering Malone s body : ju.M above the heart.Funeral services for Malone were scheduled this afternoon at 2:30 at the Ponder Baptist Church. The Rev. George Fowler, pastor of the church, was to officiate, and burial was to be in Plainview Cemetery west of Krum under direction of Schmitz - Floyd - Hamlett Funeral Home of Denton.Other than his wife and daughter, survivors include a son, Bobby Sam Malone of Ponder; his mother, Mrs O. B Malone of Denton; j a brother. Sterl Malone of Crow-lov onp grandchild.
