NEWPORT.THK DIGBY-MILLER DIFFICULTY—POSSIBLY £ DYINGDECLARATION.Mr. Augustus Miller, who was shot by Mr. Sam. Digby a few davs ago, was pronounced by his physicians to be in such a dangerous condition that it wasdeemed advisable to take his statement under oath as to the difficulty, which is as follows:“Campbell county, Ky., Decembor2, i«74.•‘Mr. Augustus Miller, duly sworn, testified and says mat on the evening of November 30, 1874, between 6 and 7 o’clock P.M., he was coming from the city of Newport, on the Campbell turnpike road. At the loot of Graveyard Hill I overtook Samuel Digby. He was walking; I was in a one-horse wagon with Joseph Schabrun. When we were opposite to him [the said Digby1 he stopped. I said: ‘ho you want to go aloug, Horace GreeleyV Just as I spoke he fired a pistol. The ball passed close to me—so close that I could hear it whistle. Fearing that he would fire again I jumped out of the wagon on the opposite side of him. The horse started up, and it lett me facing him. I said to him: ‘What are you firing at me lor? He said:‘You damned son of a b—li, you are the man that I am alter.’ He held up his pistol at me and snapped it at me, and not seeing any chance to get out of his way, I tried to grab him. The pistol snapped three times, and the fourth time went off. I threw up my hand to catch the revolver, when it went off, and the bail went through mv finger and into my left breast. I then grabbed him anu threw him down and fell on him. He rolled over ’ \ aud got on top of me. then snapped the pistol at me- again several times, right at my face, but it did not go off. He then struck me in the face with the pistol several times. At that time I got my fingers in his eves, and by that time Mr. Schabrun came to my assistance anil got him off of me, and Schabrun helped me up and into the wagon, and we started home.
