Uot i women screamed. As they reached Thompson’s body, they heard h man’s voice again, this time utteij-ing threats of bodily harm. Look- 1 ing in the direction of where the sound came from, she saw a man ' standing on the hill. She ran t$- 1 ward the man pleading with hi hi not to shoot. He had a gun in hfis hands, it was ‘'broken open at (lie time she was closest to him. She came back onto the highway at about the same point she entered the field. Her husband appealed to the man on the hill for assistance, informing him that a man had been shot, but no response came. The man on the hill disappeared as they drove off witn Thompson toward Marklesburg for surgical attention. On completion of direct examination the witness was excused until later on account of her physical condition. She will be recalled later for cross-examination.Ella Mae Thompson, widow of Harold Thompson, was called to the stand. She testified she was married to Harold Thompson on Dec. 0, 193f. She testified she accompanied her husband and the Cunninghams to Paradise Furnace on Aug. 11. After spending the day at her father’s home, the party started home about 8 o’clock, It being their custom to travel the backbone road. Cunningham stopped the car opposite the Widner cornfield for the purpose of defecating. The motor was turned off and the lights kept, burning. Thompson also decided to leave the car and had stepped back of it. She heard a man’s voice; then a shot rang out and she heard a. noise as her husband struck the ground. She leaped from the car and screamed as she saw her husband lying on the ground. The man's voice at this time was heard again uttering threats of bodily harm. She knelt! by her husband as Mrs. Cunningham ran to Thompson’s aid. M»*s, Thompson saw the. man on thehill.. Cunningham called to the/man for asistance, but he did nof respond. The night was clear and the moon was shining bright. Thompson was placed in the car and rushed to Marklesburg. ami j thence to Huntingdon. Mrs. Thompson testified the stop on the highway was not marie because of any defeels with the car. The witness testified she knew Widner prior to Aug. 11, and that no Ill-feelings existed between them. She denied making any statements of the occurrence io persons niuued by defense counsel.At this juncture court recessed until 1 o’clock.Tt was indicated that the Common weal ill’s testimony was nearly completed.
