I offered to take a blood test, but Burke said no, Harless testified.Officer Burke testified that blood tesls are not given to anyone but the drivers involved in an accident, and that “I didn’t ~ see any signs that he (Sobel) was in*’ toxicated” Burke denied that the physician was unsteady” on his feet, as Harless and other witnesses who had stopped by the accident scene had said.Smith and Harless testified that they each had consumed about six 12-ounce cans of beer early in the evening, but werefeeling no effects of it by the time of the accident.Sobel testified that he had seen the headlights of the van from about 101) yards away, and had assumed it was coming toward him. lie said he also saw a third headlight, from the ear he says was behind the van.As his car moved closer, he could tell the van was stopped, and was across 1 he center line.The doctor said he pulled as far ufr the right of the road as he could, and was going about 10 or 15 miles an hour” when he heard the scraping noise.He said he traveled some way down the road, not certain that he should stop on a lonely, deserted road at that time of night especially with my wife with me.”But realizing he had scraped the van, he slopped, opened the door and leaned out to back up, using the center line as his guide.Mrs. Sobel said she felt a bump as the ear backed up, and is not sure that they might not have backed over Smith as he Lay in the ' road.But Smith's doctor said he does nol think Smith’s injuries indicate that he was run over, but struck by the car.According In the mcdieul testimony.
