Joseph Warf Charoed With MurderCounty Attorney John C. Har- ' rison today filed first degree , murder charges in district court against Joseph C. Warf. 33-year- j old Helena hair stylist, in the -hotgun slaying of Raymon Clair Toll. 38-vear-old carpenter and 'ogger. in the Warf residence at 1208 Twelfth. Nov. 17.Warf had been charged with premeditated murder in justice court but entered a plea of inno cent to the charge through his attorney, John W. Mahan. Justice if Peace James C. Clarke ordered Warf bound over to district court.;He has been held without bail m the county jail since the shoot ng. !A coroner’s jury verdict was,' that the said Raymon C. Toll •ame to his death on Nov. 17, 1957. at 1208 Twelfth. That the •ause of death was a gunshot wound and that said gun was held in the hands of Joseph C. Warf. We recommend that the said Joseph C. Warf be held for trial in district Court.” ;Three witnesses testified at the inquest called by Sheriff-Coroner Dave Middleraas that Warf told them after the shooting that he had killed a man. Mrs. Roger Landry, a neighbor at 623 Montana, said Warf told her that he had to kill the man because the man was going to cut his throat, jHarrison listed the witnesses he will call as: Middleraas, Deputy Sheriff Larry Lytle. Dr. 0. J. \nderson. Deputy Sheriff Bob Maras. Mr. and Mrs. Elmer Ed ien. Mrs. Joseph Warf. Mrs. Raymon C. Toll. Tokyo Ball, Mary Lou Landry, and C. 0. Glover.Harrison did not state a specific • time for Warf to appear in an--wer to the district court charge.
