This will be checked lip at the state auditor's office and when this is completed Treasurer Newton Cameron will go to Indianapolis to make the semi-annual settlement for Hunt* ington county with the state. The case was fought hard by his wife, Mrs. (Harvey) Coon. The case is probably the direct result of a hasty marriage, with the usual re* suit. The young couple, Mrs. Coon being but sixteen years of age when married, did not have the best of encouragement in starting out in life, which resulted in the break-up of the family. After they were married Coon worked for the American Express company and then decided that he wanted to visit the west and went to San Francisco. The case is one in which Henry Lain brought suit about two years ago against the railroad for damages resulting from an accident which befell him in the local yards. The circuit court gave Lain judgment against the railroad company and the company appealed the case. Lain had to have his shoulder taken off in a Chicago hospital as a result of the injuries received.Clear Creek Survey.County Surveyor Smith and Commissioners William Fulton and Benjamin Heaston will start Thursday on their survey of Clear creek under the order of the circuit court on the petition of R. A. Kaufman. The viewers will begin work in Whitley county and work down the stream. They will probably not be able to finish viewing the stream in this preliminary survey before next week. No stakes will be set this time but the trip will be with a view to noting the general topography of the land.Other Court News.In the case of Rebecca H. Murray vs. Thad Cheeseman et al., account, restraining order released, cause dismissed and costs paid, all by agreement of parties to the suit.Sandusky Portland Cement company vs. George W. Powell, A. B. Cline of the Cline Lumber company, complaint on account, has been filed by Simons Chiles of Warren.The case of Wagner Oil company vs. Theadore T. Hamilton, injunction, was heard today. Among those interested in the case are Attorneys Field Sw'eezev and Robert Van Atta of Ma-■Ipoint the state has no right to inflict death. He further argued that a penalty of death is not a deterrent of crime as much as is a penalty of life imprisonment. W. A. Branyan lead in the discussion by a review of the paper, favoring the retention of the death penalty for extreme cases. He argued that such punishment is a deterrent and in states where it has been abolished it has been restored or there is talk of restoring it Several other members of the club took part in the disucssion, the club being rep-resnted by an attendance of sixteen out of twenty members. The audience was not a large one.At a business meeting of the chib held prior to the public meeting it was voted that the postponed meeting at which a symposium on the Concentration of Wealth” wras to have been given should be held January 17.
