Peppin, alioriff of Lincoln County, in relation to the actual condition of affairs there, i« published in the .Vrie Mexican of tin* 24th of August. Col. N. A. M. Dudley, commanding Fort Stanton, sends the affidavit to Gov. Ax tell, with Iiin endorsement, ns to tin; finds therein stated.In addition to the nflidavit of sheriff Peppin, a delegation including the Probate Judge, County Treasurer, County Commissioners and Justice of the Peace of Lincoln County, also waited upon the Governor and presented a petition, asking for protection.The Governor has forwarded their petitions to the President of the United Stales with a strong request, us governor of the Territory, for assistance from the I nited States, to protect the people from domestic violence. If the governor’s request it; not granted it will probably become his duty to convene the legislature.Col. Dudley, in his endorsement of she rill’ Peppin’s affidavit, says:4,J have carefully examined this nflidavit, and do not hesitate to state.I believe it t lt;* be a plain unvarnished picture of the present state ol*affairsin this count y, atul one that is spreading and increasing daily.New parties have arrived within the last six days. One of them yesterday dismounted a citizen, a farmer on the Rio Hondo, stripped him of his clothing and forty dollars in money. They then proceeded to the vicinity of the 1‘ccob, and stole some ten head of horses.The raids they have commenced on the Mascnloro Apache Indians, in my opinion, in less than sixty days will result in an Indian war,’which will devastate not only Lincoln county, but ranches in the vicinity. 1 have written ho much upon this matter, without eliciting anything, that at first I refused to forward the encloseddocument, but sheriff Peppin assurod me that it was the last favor of the kind that ho would solicit at my hands,*’.Sheriff Peppin closes his affidavit as follow-;“Deponent inorovcr declares that hr? accepted the appointment of high Hierlffof Lincoln county only 011 the understanding that he would bo legally supported by the military force i:t Fort Stanton. That lit* immediately entered upon the discharge of his duties, with not only a conviction that the position was an honorable one, but that he would he sustained in the discharge of his duties by the authorities appointing him. That notwithstanding he (deponent) has reported to General Dudley, commanding the post at Fort Stanton, tin* results of all his official net-, all of u hich information has lo his personal knowledge been reported by General Dudley to liia Excellency the Governor, and to the District Commander, from the date of his appointment to the present hour, he (thedeponent) lui- never received the Herat eh of a pen from Ids Excellency the Governor, or his secretary. Affiant farther deposes that since his appointment be lias visited every town, settlement, or stream where parties would be likely iu cauip accompanied w ith two or three exceptions by the principal stock owners of the county, and that during Idsterm of service nlt; -hcriff of Lincolncounty and sjieciul deputy U.S. Marshal his experience has convinced him that it is wholly impossible to restore order and pence in Lincoln rounlv without the strong arm of the military. Deponent farther deposes that • •a the oth day of August last an armed body of men headed by Sen clock, llowdrio, French and Kid, in nil twenty or more, attacked the Me senior© Apache Agency, killing the chief clerk of said agency, one M. J. Ilern-Mein, robbing him of Ids arm- and contents of pockets; that these parties are personally know 11 to him, but be in powerless to arrest them without the aid of the militarv. Affiant further deposes that in Ids belief unless some steps are taken to prevent a recurrence of Mich or similar attacks mi the Indian Agency a general Indian war is inevitable! Deponent further states that during his term of service lie has never received nnv complaint of the Mcscftlero Apache Indians having commit tod any dcpro-dutious within the? county, but that there lias heen evidence submitted to him that depredations have been eom-luitcd by the law less bauds oil the Indians and number- of horses stolen from them.”
