Russell “Dusty” Weisse again denied in Santa Monica Superior Court Wednesday that hemurdered Marina del Rey yacht owner Robert H. Finkbine.While undergoing cross-examination by Deputy Dist. Atty. Burton Katz, Weisse, 25, of Oxnard, was asked if he had willingly purchased a pair of handcuffs, knowing they would be used in commission of afelony.“I knew I wouldn’t have beenthe one who done it just like I didn’t do what I’m accused of,” Weisse replied.Weisse is charged with the Oct. 11 fatal shooting of Fink-bine, as well as counts of kidnaping and robbery.Prosecution witness Gary Paul Duncan, 22, has previously testified he and Weisse had discussed stealing Finkblne's 45-foot yacht and they had boarded the yacht, posing as security guards.While at sea, Duncan has said Weisse forced Finkbine, 48, tosign a bill of sale for the yacht, then shot him in the back and dumped the body overboard near Ventura. Police say the body has never been found.A Los Angeles attorney then bought the yacht, The Hedonist,for $47,500, with Duncan saying he got $5,000 and Weisse the rest. Weisse was arrested on April 7 in Oxnard.
