(tf—Jesse Modes w^s scheduled to go trial • in Folk County Superior Court here today charged with assault with a deadly weapon' with intent to kill his wife. \Rhodes, former Polk County accountant, pi* viously. ~ chargedin the murder of Edward A. Ball,31, Tryon theater manager. The charge was dismissed after a coroner’s jury found that Ball met death at the hands of unknown persons, the May 24th murder still is' unsolved.Mrs. Rhodes testified at k pre-| liminary hearing that she had been riding with Ball early on the morning of the 24th. She said, her hus-| band appeared with a flashlight | in one hand and “something else! in the other. Several shots were fired, she related, and Ball was struck in the shoulder. ■*A second shooting brought death to Ball-in his theater later in theci day. . ..
