Then, in July, Seard’s attorney again questioned his competency during a pre-trial hearing.Abies ordered a psychiatric evaluation of Seard to be done by Dr. Raleigh D. Wood. Wood reported to the judge last week that he felt Seard was incompetent to stand trial.Seard's competency continually has been questioned since his arrest in 2003, and Curry believes that another competency hearing will be the fourthin this case.“The problem with competency is that it is an issue that can be raised at any time,” Curry said, “Even if we were two weeks into his trial, the question of competency can get brought back up. ”Seard’s attorney, Kurtis Rudkin of Boeme, could not immediately be reached for comment.Back and forthEvery time Seard is found incompetent, Curry said, he is returned to the North Texas State Hospital. There, the hospital conducts mandatory reviews to evaluate his competency.Once hospital officials find Seard to be competent, he is sent to the Kerr County Jail to await trial.
