But it is something we have to do for the safety of our guards and the other inmates. ”Back storySeard is charged with capital murder for the March 10,2003, deaths of Patricia Kutzer, 59, and ferry Ingram, 52.Their bodies were found in the driveway of Kutzer’s home. Accordingto police reports, the two were bludgeoned to death.Ingram's son discovered the bodies and called police.Seard left behind several key pieces of evidence against him at the crime scene. Police reported that Seard's driver's license and a picture of himself from a compact disc advertisement were recovered.Seard was arrested days later in Signal Hill, Calif.In September 2003, twice in 2004 and again in 2006, Seard was determined incompetent to stand trial.In 2006, Austin psychiatnst Dr. Richard Coons testified that Seard believed he had a presence in his life that made him the “evilest in existence” and was not fit to stand trial for the murders.In June, Seard was found competent for trial and a capital murder trial date was set for November.Curry said that finding may be a good indication for the future.“This case is unique because we have experts for both the defense and the state coming back with the same findings every time, whether that be competent or incompetent,” Cuny said. “Now that he has been found competent once, that may be a good sign that we can get that to stick in the future and move forward.”
