Suspect Plans Appeal To Keep BulletRICHMOND (AP) - A judge says the bullet in Rudolph Lee Jr.’s shoulder — which police believe will link him to a robbery and shooting — must come out, Not before Lee gets a chance to appeal to the Virginia Supreme Court, though, Circuit Court Judge James M. Lumpkin ruled Wednesday that authorities have a right to remove the bullet, which they hope to use as evidence in Lee’s trial for the July 18 robbery of a Richmond market.Lumpkin delayed his order for one month, however, to give Lee the opportunity to appeal — and Lee’s attorney, Joseph R. Winston, said an appeal will be filed in the next few days.Lee, 26, is charged with robbing the market and shooting its owner, Ralph E. Watkinson,Watkinson told police he also shot the robber in an exchange of gunfire. While both men were being treated at the Medical College of Virginia Hospital, Watkinson identified Lee as the man who attacked him,Lee told police he was shot by two robbers.Police want the bullet removed from Lee’s shoulder to determine whether it was fired from Watkinson’s pistol.An MCV doctor testified the bullet is lodged just below the skin and could be removed with little risk to Lee’s health.It wasn’t removed at the time of the shooting because it didn’t pose a health problem, doctors said earlier.Lee is being held in the Richmond city jail in lieu of $10,000 bond. Judge Lumpkin refused Wednesday to lower the bond.
