Most of the spectators werewomen.Jurors, upon retiring, will he furnished various forms of verdict to be tilled in and signed, according to their findings. One form is for first degree murder, without qualification, the penalty for which is death in the electric chair. Another is for first degree murder with the jury’s recommendation for mercy, under which the court may set aside the death penalty and sentence the prisoner to penitentiary for life without opportunity for pardon. Other forms provide for second degree murder, manslaughter, assault and battery and acquittal. Still others provide for 'finding of insanity under as | pleaded by attorneys for the defense. I rite defense may appeal to higher courts from any of these verdicts, but no appeal the state can take would street the prisoner in this case.Criminal records of Stark county show that only one man has suffer'd the death penalty iu the electric i hair.
