The father worked during the night and alleges that Ills/absence afforded Mr. King an opportunity to 'tend to the baby, which he did. when the guests would permit. The King property was attached on behalf of Wacker. A criminal suit for adultery was begun at the same time.The criminal case pame off before justice Slikkerveer yesterday forenoon. Wacker testified that on the night of Aug. lltLx he came to the ..hotel from the round house and saw his wife and King enter the latter’* room. Mrs. Wacker slept in the room adjoiuing Wacker got. night watch Henry Murray and Bernard Ruali and they peeped through the window of Mrs. \Yacker’s room and saw that the bed Was empty. Mabel Elmert,.formerJy a servant in the Wacker household, testitied that King was very assiduous in his attentions to Mrs. Wacker and used to bring her candy and tend the baby. In the face of the testimony of Wacker, Murray and Rusli, attorney Clarence A. Plank areued to the court that it would be wrong to place a stigma upon the name of King by holding him to the grand jury.. Attorney Klay thougt the evidence was conclusive and the court agreed with this view, binding King over to the grand jury in vlie sum' of S500 bonds, which were given. All of the parties were present in court, which was held in the court room of the court house.
