Council calls tor inquestCity asks medical examiner to delve Flannery deathby KEVIN BELL Sun StaffCity council will call on the province to hold an inquest into the mysterious death of Keith Herbert Flannery, whose body was found floating in the Assiniboine River last month.Council agreed Monday on a motion introduced by Alderman John Kelleher to request that the Chief Medical Kxaminers' Office of Manitoba “conduct an inquest into this affair and report back as soon as possible.”The Fatality Inquiries Act states an inquest must be held into any sudden death of a mental institution resident, but the city must show its concern over the incident and “the void of information” surrounding the death, Aid Kelleher said.Flannery, of Pipestone, was found in the river July 15, 11 days after he was reported missing from the Brandon Mental Health Centre. He was committed to the institution last year when he was found not guilty by reason of insanity on charges of murdering his father and cousin.Aid. Kelleher said he was concerned about the case because Flannery was known to slip into a psychotic state when he was not under medication.He could have been dangerous, but the public was not informed that he was missing until the local media revealed his identity after his body was pulled from tin1 river, he said RCMP and officials from the mental institution have not officially confirmed it was Flannery who died.Some aldermen objected to the motion, arguing that a request for an inquest was none of the city’s business.“Are we going to look a little silly as a council getting involved in a matter beyond our jurisdiction?” Alderman Fred Anderson asked.\ld Kelleher said BMHC is within city boundaries and council is empowered to look after the welfare of city residents.Alderman Ross Martin said the city is justified in asking questions about tin* case.“Someone, who is supposedly dangerous, escapes and nobody is notified and then this person happens to end up dead. 1 think we’d be looking foolish if we weren’t concerned about the welfare of the community.”Aid Kelleher originally introduced the motion without notice at a council meeting two weeks ago, but he failed to get the required two-thirds majority of votes to include it as a last-minute item on the agenda.A spokesman for the Chief Medical Examiner’s Office said an inquest review committee will meet Aug. 28 to consider the case and determine when an inquest will be called.
