Craigen, druggist, was lie next witness. lie testified that nine time ago Kimberly came to his stablishment and purchased an ounce f^chlorofonn, which he said he (Kim-n*rly) intended to use to detect a party sdio had been robbing his spring-house i the milk therein kept; tliat lie in-ended putting the chloroform in a jar f milk, and, taking out all the other ,rs, leave kthe chloroformed jar as a de-ective agent to discover the nocturnal hief.Mr. Craigen stated, however, before ic left the stand, tliat the chloroform, laeed in an open room, as deserilied y Mr. Jilulaugh, could not possibly mve affected him to the extent of pro-lucing the extraordinary stupor which VIr. 11. thought occasioned undue som-aulency on the night and morning preceding the roberry. At the conclusion if Mr. Craigen’s testimony, Joseph Wart bun was called and sworn- He testified tliat on the night of the ‘31 ofnlugIng i prajbo'ilmoiStanttlOHtheTlivewasus j ual ten.Alugwining.lob the 1 Hi andTill'•11da*HerIoral)udie.1stcrupraJuly last, himself, KimUrly and a man named Bamuel Porter, went to Ulu-tjaugh’s house, and that Kimlierly poisoned the dogs, after which they made considerable noise knocking on the palings to ascertain whether the dogs bad been really killed or not. They then made a forcible entrance into the house through a window and secured the Iiocketbook of Mr, Blubaugh. Witness further testified tliat he afterwards divided the money between Kimberly and Porter, keeping the lion's share himself. To use ins own words, he kept one-iialf of the amount and divided the other half between Kimlierly and Porter. The witnesses for Kimberly were Kimberly’s wife and an elderly couple named Cage, who were the father-in-law and mother-in-law of the accused (Kimberly.) These witnesses testified that, to the test of their belief, the prisoner was in his lied from a little after 10 o’clock at night until 5 o’clock in the morning.After the testimony in this ease had been taken, Kimberly was charged with the following separate offences, in all of which Warthan gave testimony and acknowledged his complicity with full and remarkable precision and detail;With entering and robbing tin house of Henry T. Weld, of Ml Savage, within 00 days last, with the robbery of a lot of tools, the property of lt;1*. Jewett, of Bai relisvilh , with the robbery of the house of Michael Mur ray, of Ml. Savage, on the 16th o! June last: with the robbery of the house of James Mattingly, on Wills creek, since the 16th of June last, with the robbery of the store of Turner 1 .ashIcy at Fliutstone on the 12th day of July last.At the conclusion of the examina tion the Justice held Kimberly for court in the sum of $500 for the first case and $100 each in the other cases above mentioned. Warthan was held for court in the sum of $500 in the first case, there being no evidence against him in the others save his owu statements The parties were committed.
