He also is charged with being a public nuisance. *As the episode is recorded in police reports, Officer John Hale went, to the Cayuta St. address to Investigate a complaint telephoned by Mr. and Mrs. Harold Smith of 207 Cayuta St. that Benjamin was “swearing and using threatening terms and causing a general disturbance.”Hale found the door locked, he reported, and says the man identified as Benjamin refused to come to the door and threatened bodily harm if the officer made an attempt to enter.Benjamin was on the second floor of the premises at the time.Hale returned to City Hall where Peace Justice Harry Tyson issued a warrant for Benjamin’s arrest.on charge of being a public nuisance.A call was made to the Pennsylvania state police at East Athens and Tprs. Mancuso, Strempek and Owens joined Hale outside theMillton address.Upon arrival of the state police, a shot was fired inside through the door which the officers were attempting to break down. A second shot followed and the pioice decided to try tear gas.While they were waiting for the tear gas, another round was fired through the door.At this point Officer Hale and Tpr. Mancuso returned the fire.A man police identified as Benjamin then surrendered to the officers.
