Dr. Burch testified briefly and explicitly as follows: Was called about 10:30 o’clock; found the boy in convulsions caused by great nervous shock and pain from a bruise on the testicle, which was of a redish color and had been struck with some blunt instrument. Remained with the boy until 1 o'clock, during which the patient had about fifteen convulsions. Called next morning and found the boy much improved, but still suffering from convulsions when placed in any position that brought a teneion on the bruised part. Then made an examination of the boy’s body and found not a single bruise on it. The boy was of a very nervous temperament. The convulsions might have been caused alone by the nervous shock of being whipped, but witness did not think so in this case.Other witnesses were called by the state without anything new being brought out. Officer Zorn testified that about 1 o’clock that night he found Dag-get in bed at the Prospect house and arrested him.The defense then called their only witness, Dr. Wray, who testified that he examined the boy’s body the morning after the assault and found it without a bruise of any kind} found a slight soreness of the testicle, but no bruise. Did not think the boy in any serious condition whatever, and told the parents so.Court adjourned at noon, and this afternoon the attorneys began arguments in the case and talked until a late hour. The defense is entirely on the line that the boy was moderately punished and that the matter was a family
