Aug I* Hlmer Ding-man alias Far) Smith, today claimed. in a habeas corpus petition, he wm not in Marshfield, Wls , Aug. ft, 1033. the date on which he is charged with killing a policeman.Judge Fred Shepherd signed an order directing Warden N. T. Harmon of the Nebraska penitentiary to bring Dingrm n into court tomorrow morning for hearing. O C. Wood. Lincoln, represents the prisoner.Dingman yesterday completed atwo-year aentence for possession of a machine gun but extradition papers had been signed previously and he was held on a charge of murdering Fred Reell at Marshfield during a roobery.
