City Named Defendant In $100,000 Court SuitTbe City of Emrotuburg, Mayor R. F. Tate, Police .Chief Adrian Brennan and Council-men Virgil Mathis, Donald Kuhn, Alden Hermansen, Vincent Kunz, Walter High and Dale Schleis-man were named defendants in a $100,0(0 suit filed in Palo Alto District Court this week by Maxine Thompson, doing business as Thompson’s DX.Mrs. Thompson filed the suit following a resolution July 27 by tbe City Council to suspend her Class C beer license for 60WeatherWednesday, Aug. 5 63 71Thursday, Aug. 6 66 79Friday. Aug. 7 65 7*days, because of alleged violations of the conditions of the license. The police chief served notice of the suspension July 28 and. according to the petition, threatened the plaintiff with legal action If beer is sold during tbe suspension period.Mrs. Thompson a$ks that a mandatory injunction be issued directing the defendants to return the Class “C” permit and be permanently enjoined from interfering with the plaintiffs right to sell boer under authority granted by the permit.She charges that the suspension was ordered without auth-ority or previous notice, and due process of law; Is illegal, arbitrary, unreasonable, tyrannicalunconstitutional and invalid.Mrs. Thompson asks damagesfor loss of beer sales, hm» ment, public ignominy, embarrassment and shame, totaling $50,000.Mrs. Thompson asks $50 00# for exemplary and $50,000 tor actual damages, particularly tha loss of beer sales, harassment, public ignominy embarassmeat and shame.A hearing on a petition for a temporary injunction to return her license was set for 10 a.m this Thursday by District Judga Joseph Hand, Emmets burg.MarketsAugust 12
