Burkinshaw claimed that he did not employ three work.-1 men,, but the conclusion of tho commla*I sion was that he did employ three or more'.workmen on houses being constructed by him bn Emerson avenue, between Fifteenth and Sixteenth South streets In Bait Lake. The commission also concluded that at the same time Jacob Burkinshaw was also employed t«\ do certain concixrte work on the houses that were being built by the defendant and that. Albert K Andrew* employed by Joseph Burkinshaw, Instead of being paid po much per day, was paid by tho defendant so much per house, viz.: $300 to build two houses at the location referred to.On June 20, Black,, ono of the employes of Joseph Burkinshaw, was injured In an accident while so employed, el concrete wall caving in on him and causing a fracture of both bones of his right leg. The defc/idan! paid the applicant $10 as compensation as a result of tho accident.The commission held that Joseph Burkinshaw was a contractor and builder and employed men, paying some a dally wage and paying others on a piece basis. It also held that A. Richter company, Inc., had a first! mortgage on the property mentioned on which Black was working when Injured and that at the end of every week tho Richter company paid Burkinshaw sums of money due for material and laborf that tho defendant, ’according* .to his testimony, was practically bankrupt and not financially able to pay this claim: that A, Richter company was holding money which the defendant owed Black as wages known and designated under the compensation net as compensation benefits.In view of this, the commission directed A. Richter company. Inc., to pay to George L. Black for and on behalf of Joseph Burkinshaw compensation at the rate of $12.12 per week, beginning Juno 24,: and to continue ho long as the applicant suffered either temporary, total or partial disability as thy result of accident and that accrued payments bo uindo in a lump sum; also that the Richter company pay reasonable medical expenses* r
