The plainfift' was, represented by Attorney Thompson * while Attorney Davidson looked after ^I the interests of the defendant.Jessie Shamp told how she had accompanied Smith to the fop of the hill and he had seized her and thrown her ; down. She managed to escape from his grasp and ran home as fast as she J( could go..Mr. and Mrs. Isaac Shamp told how Smith had come past their back porch and asked their daughter if she knew where there was some burdock, as he wished to make some root beer She replied that she did, and he asked her to accompany him She asked her father if she could and was told that it would be all right. The next thev saw of their daughter was when she returned home with her clothing torn and marks on her neck.Harry Thompson, who resides at Franklin and Hill streets, saw the girl come down the hill on the run. and she seemed to be holding her dress at the neck with one hand and trying to hold np a stocking with the other. He also saw Smith come down the hill after her. hut Smith turned and went another direction before he reached him.This closed the case of the state, and the defense presented no witnesses. Smith was sent to jail, and this morning was still trying to get bond.
