cent wiinoiic.Defense Rests; Allaway Trial Ends AbruptlySANTA ANA — The defense in the Edward Charles Allaway mass murder trial here abruptly rested this morning without calling a single witness.Public defender Ronald Butler had been expected to deliver an opening statement and to call witnesses in a bid to show that Allaway was mentally ill when he shot and killed seven persons at Cal State Fullerton July 12, 1976. Belated Story, Page MSuperior Court Judge Robert Knee-land requested a meeting with both Butler and prosecutor James Enright immediately after the defense attorney rested his case this morning.He issued a gag order after the conference, stating that neither attorney is to discuss the case with reporters.Kneeland said in an interview after issuing his gag order that he did not want to take a chance that the jurors would hear of statements in the guilt-innocence phase of the trial.Before the conference was called, Enright expressed surprise at Butler's decision to rest the defense case without calling witnesses.Allaway’s murder trial has been marked by its speediness, both Butler and Enright have said, because the defense doesn’t content the charge that the 38-year-old former university janitor actually fired the shots that killed seven persons and wounded two others in the college library last year.Butler apparentty intends to save his arguments and witnesses for the sanity phase of tbs trial.Butler already has conceded thathis client physically carried out the shootktts at the college library, but insists Allaway was mentally incompetent at the time.if Allaway is convicted of the first-degree murder charges, a sanity hearing will be held to determine if he were legally sane at the time Enright rested the prosecution’s case Wednesday after calling a string ofeyewtaesaea to thtshootingapree — including two persons who ware shot and wounded by Allaway..
