MAN KILLED NEAR MOUNT JUDEA IN NEWTONCOUNTYShot Twice, Once Near Heart, Says He had no Intention to Kill, but did so to Protect Himself Against Stones and Being Knifed.George Cross, of Jasper was killed near Mount Judea Saturday by Dave Smith. The slayer was taken into custody yesterday by Sheriff Sam Hudson and lodged in jail to await a preliminary examination, at some date in the near future according to information received here today.The killing arose out of * Cross’ domestic troubles for which Smith was supposed to be responsible. . It seems that the slain man and his wife had parted several months ago, though they were not divorced, and Cross had gone to live in Jasper, his wife remaining at her home near Mount Judea. Saturday Cross went to Mount Judea to see his wife and found her not at home. He got into an altercation with Smith whom he found coming along the road from Jasper and the killing resulted, it appears that 110 one else was present at the time but the sheriff was notified and took Smith in custody yesterday. Both the two parties to the tragedy were middle-aged men of moderate circumstances and farmers by profession.M. F. Franklin, of this city, who has just returned from, a visit to Jasper where he sold a car to Dave Smith, has given us some further particulars in regard to the killing. He says that Cross had been making threats against Smith as Mrs. Choss testified at the inquest yesterday and that Cross attacked Smith on the highway by throwing rocks at him and threatening him with an open pocket knife. Smith, who is a very small man, claimed he was carrying a gun' because he had heard or Cross' threats against him and that he had fired three shots with the hope of keeping his assailant off of him before he killed him, but that Cross who was known to be “high-strung” just kept ccrming on.
