We heard some shooting in the direction the negro ran. The negro ran across the road ahead of us and we stopped the car and I jumped out and called for him to stop, and he did not stop. I shot \jntil he fell.Deputy Arthur Sheppard next testified that when he reached the Lowman house the Sheriff directed him to go to the left. A negro man came out of the house with a shot gun. I took after him and ran him around the house, after the Sheriff was shot. Had I known that he had shot the Sheriff I would have killed him right there. 1 went back to the house and Sheriff Howard way lying on the ground. . ( stooped down and saw he was dead. The negro in the yard shut three times at me. Clarence had the gun. I shot five times at the' negro in tlve yard.
