SUPREME CODRT UPHOLDS JURY AWARD IN CIRCUITCOURT FOR DEATH OF HARRY NICHOLS,AN EMPLOYEOF COURTTODAYtoDecision affirming the $6,175 award, gether with Martin, Martin , Martin,of damages which a jury in circuit court here gave to Mrs Mary Nichols in the $10,000 damage suit aginst theManitowoc Dry Dock Co., for^ thedeath of her husband Harry Nichols,» 1was handed down hy the supreme court today and the Dry Dock Co., or Insurance companies with which it carried risks on employes, must pay the judgment ■ With costs and interest the judgment will amount tc about $6500 it is said., The case was heardiin circuit court here in August 1912.Nichols was killed in’* the shops o£ the Dry Docks Co. three or four years ago when he was caught in the shafting of some machinery while adjust ing a belt. His clothing caught andhe was whirled about the shafting and± ■torn limb from limb, the-first knowl-iedge employes of the shop had of the 'accident being when . InA ••* *d.enying its own negligence, the ' oin-pany alleged the accident was due to Nickels’ carelessness by placing himself lso near to. a revolving,shaft that• »his clothes caught In It.Nash Nash and Doe Bullhorn, Milwaukee, appeared as attorneys for4the company, and Hougen Brady, to-of Green Bay, of counsel,plaintiff*f^r theInteresting Case Decided—‘‘When the law fixes as a measureJdamages the market value of properly injured or destroyed, it means theVmarket value for lawful purposes.” This contention advanced by the .C. N. W. Railway Co. in defense of a suit brought by T. D. Miller, of Saukcounty, for recovery for a slot machine damaged in transit,, was upheld by the supreme court today when a ower.court award of $75 given to Mil-er, was reversed. The machine was, Ishipped over the Northwestern lines and valued at $140 when consigned to» • fthe company. Milter sued for dam-ages for injury to the machine and the company claimed that the value was excessive as it was based upon the use of the machine as a gambling device. The court upholds this view.City of Sheboygan Wirte—The supreme court reversed the decision of the Sheboygan court, overruling a demurrer of the city in the base of F. R. Evans vs. the. City, for damages wrhen caught on a bascule bridge while riding a bicycle The city was charged with neglect in noti •providing guards or warning A demurrer was filed, based upon the decision of the federal court in a Milwaukee case where the city was held not reliable and the supreme court sustains the demurrer.
