Before Judge Torrance—Wednesday.The bastardy case against Deputy Sher-iff Merwin, of Durham, that was set down for trial to-day was postponed for one week, on account of the illneSs of the complainant, Minnie Carey. Minnie has been in very poor health since she gave birth to the child arid at times hercondition has been critical.- The townphysician,who has had charge of the case, was called to the almshouse yesterday, and found her suffering from a very severe cold and sore throat, which he stated prevented her from being able to appear. Her nervous svstem is completely broken down also, and it was considered unwise to • summon her before the courtto-day to tell her story. Counselothor side objectedto the delay, and Attorney Newton said the case to Merwin was more than a question of dollars and cents and he wanted it tried speedily. Judge Torrance said he would have It set down for trial next Tuesday at 10 o’clock, and if the girl wasunable to appear at that time, it wouldhave to go over until the September term.
