LE MAR GIVES HIS VERSIONDEFENDANT IN MURDER CASE TELLS HOW HE KILLED THOMAS DELANEYRose Givens Once in Jail Charged With Being Accessory Gives Testimony for Defense.The interest in the I,e Mar tria’ reached ifk climax today when, after court had re convened at 2 o'clock the defendant took the- stand in his own behalf and told the story of the shoot t ing at the tin house. lt;He had heard threats that Delaney-had made about getting the other man and after returning one pistol he borrowed another and went to tin Tin House* IJlt;* retired with Rose Gn• •its, and about three o’clock in the morning he heard Delaney come in.Delaney passed down the hall, andlater came back and demanded thatfite door he op* ned. This the woman and Le Mar refused to do. Then Del aney put ids weight against the door and broke it open. He had a pistol in it!'- hand and the doh-ndant said they both find at thlt; same time. Then he walked ou of the room and later went to 1'ndc t hill s house. Alt Hickox's evidence consisted in intro during a plan of the building wher* the shooting occurred and an expert explanation of tin same. Mr. Dearborn testified to finding three bullet toles in the room alter the tragedy j two on the west wall and one on the j south wall, also a bullet mark on tie door, one* on the overhead rafter an . a third on the wall ol' the adjoinim room.
