R. 5. Terre Haute, of the Manor House, 1349 Margaret Avenue, was deferred for a week by Judge Edward S. Everett in City Court yesterday morning to permit the prosecution and defense to submit briefs on the motion.Attorney Lenhardt Bauer, counsel for the defendant, expressed the view that the state, in not’an-an*r50lift- «4vW MJOIWswering his motion, admitted the facts set out were true. Deputy Prosecutor J. Morton Swango contended the state is not required by law to answer and that Attorney Bauer’s motion amounts to an objection which could be made when the case is tried.The motion sets out that Traum arrested by state police in a series of raids on three so-called nightclubs, two diners and a restaurant March 30, was deprived of his constitutional rights when officers entered the place without a search warrant It also calls for the return of slot machines, a dice table and a roulette wheel confiscated by the raiders at the tyanor House.The court informed both Swango and Bauer to cite reasons to support their conflicting views on the necessity of the state to file an answer to the motion to suppress evidence. Attorney Bauer filed the motion in the court April 10.Cases of four other persons arrested in the raids will be brought before the court this morning for arraignment. These include Ernest Kelley, 38 years old, 2003 North Ninth Street, of the Pine Ranch, 3511 Maple Avenne; Claude A. Wetherbee, 438 South Twenty-first Street; Jack I. Selby, 644 Walnut Street, and Mickey Shannon, R. R. 7, Terre Haute, all of the Fort Harrison Boat and Saddle Club, R. R. 7, Terre Haute.Three other defendants arrested in the raids, Richard Guth, 32 years old, 1512 Lafayette Avenue, of the Batchelor’s Truck Stop, at that address; James Harmon, 28, 1467 Lafayette Avenue, and Clifton Harmon, 34, 1474 Tippecanoe Street, of the Hannon Diners, 2731 Wabash Avenue and 1462 Lafayette Avenue, have been fined $25 and costs on their pleas of guilty to possessing and keeping gambling devices.
