A.Doug Hendry, faced two sets of charges:- Grand larceny, for allegedly stealing an auto engine last Dec. 7. He faced five years in prison on the charge.- Violation of probation. Earlier last December he pleaded guilty to a burglary charge and was given probation. He was accused of violating it. Carlton and presented the negotiations for his approval.Taylor told the judge that Hendry would plead guilty to both charges against him: stealing the auto engine and violating his probation.In exchange, Pellecchia said, he would recommend the judgeimpose a senience not greater than one year in the cojnty stockade.UNDER TERMS Of the deal, Carhon could senlence Hendry to one year for the theft and another for the probation violation on the burglary charge, but boih sentences would run concurrently /nr a total of one year, they saidThe deal also included the judge ordering a background investigation of Hendry prior to sentencing.Pellecchia fold the judge that everyone involved was agreeable to the deni, including the sheriffs deputies who arrested Hendry on the theft charge and probation officers who charged him with violating the probation.“We feel these negotiations are fair, the prosecutor told the Judge.•Carlton accepted the deal with one condition.“IF I CAN’T go along with the plea bargain because theends of justice will require a different disposition (a longer sentence), 1 will allow him to withdraw his (guilty) plea and go to trial,'' die judge told the attorneys.The judge asked Hendry lo explain the crime he had just confessed to committing.“We got together, me and two other people... and went to Otto’s (a car repair shop) and picked up this motor,” Hendry told him.You took it out of an auto?” Lhe judge asked.“Yes, sir.”TWO OTHER MEN were arrested with Hendry on the alleged auto theft charge, William E. Saunders, 2a, of 4011Coconut Circle’ N. and Dennis Ray Ard, 22, of 2785 Florence Court. Both are awaiting trial.Pellecchia was asked if part of the deal with Hendry included his promise to testify against the two others. The prosecutor refused tocomment.Carlton said he will sentence Hendry when the background investigation or him iscomplete.The pleas Tuesday ended a long round of legal hassling in the Hendry case. Taylor earlier had asked Carl Ion to move Hendry's trial out of Collier County because of the publicity the case has received. Carlton had temporarily denied the request.
