ISupreme Court.(Present: Chief Justice Norwood.)April 10, 1910.The King* vs. Nathan Roberts, (ill* bert Roberts and Earl Burgess.—Court adjourned at 1 p.m. for recess, and continued at 2.30 p.m. till 6 o’clock, when adjournment was taken for supper, and at 7.20 the hearing was again taken up. Following the examination and cross-examination of the many witnesses, the Jury was addressed hy Mr. I Tow ley, K.C., for the Crown, and Mr. Higgins, H.L., for tiro defendants. The Chief Justice in charging the Jury reviewed the full evidence. At 10 oclock the Jury retired, 1 lie Chief Justice having directed that there be two counts on which the prisoners were charged, conspiracy to cast away a schooner and conspiracy to defraud an insurance company. At 11.45 the Jury returned to Court and through their foreman Patrick -Walsh, reported that they had j found Gilbert Roberts “Not Guilty” on either count, and that they had found Nathan Roberts and Earl Burgess guilty of attempt to defraud an insurance company. When the verdict had been announced Mr. Higgins for ilie defendants asked to be heard in mitigation, and on Friday next the sentence will be delivered.
