(AP)-A Davison County grand jury was ordered Monday to in-vestigate an alleged beating of a Mitchell man last month at a private club here.Circuit Judge George Wuest ordered the grand jury into session after he dismissed aggravated assault charges against two Artesian men last week in the March 1 beating of Richard Goodmanson of Mitchell.Wuest said the evidence , presented at the hearing was not sufficient to warrant a trial against Boyd D. Hopkins Jr., an Artesian banker, and LaMoine L. Torgerson, an Artesian insurance salesman.His decision to drop the assault charges was controversial in the Mitchell area. After the fight, Goodmanson was hospitalized in Sioux Falls with multiple “life-threatening” injuries, a physician testified. Good-manson’s fiance and a 17-!• year-old bystander also -. testified that they witnessed the beating, which took place , outside the Elks Club.“It was my opinion the evidence didn’t show probable cause of aggravated assault. However, the state may resubmit the evidence to the grand jury for their opinion, and any other evidence may still be presented,” Wuest said.Last week, Wuest noted that drinking was involved in the incident and he said Goodmanson had a chance to walk away from the confrontation but chose not to.The judge removed himself from any further action in the case. He also excused the foreman of the grand jury, BoydD. Hopkins Sr.State’s Attorney Patrick Kiner said he wants to convene a grand jury as soon as possible, although he said it might take a day or two to finalize arrangements with Circuit Judge Thomas Andert.
