MAXWELL GETS HEAVY FINEFive of Jury Stood for Prison Sentence—Four Hours to Reach Verdict.The Jury in the case of the state of Indiana versus Jesse Maxwell. lt;n trial for assulting Edward Perry with a club on the 14th of last January returned a verdict Saturday afternoon, fining Maxwell $800. The jury deliberated four hours before reaching an agreement. At the outset five of the panel voted for a prison sentence, some were for a fine of $1000, some for $500 and one for $25. The verdict came as a compromise. Maxwell and Perry lived at Ora at the time of the trouble, but since the latter moved to Hass Lake. Maxwell had engaged Perry to build a wagon. In a dispute for settlement a passage: at arms was narrowly averted. Next day Maxwell cameout of his house as Perry was passing and knocked the latter down with a club. Perry scrambled to his feet and fied north along the sidewalk, Maxwell after him. Near the Erie railroad Maxwell overtook him and again belabored Perry with his club. laying the scalp open so badly that the services of a surgeon, Dr, Kelsey, were required to sew them up. Maxwell appeared before Squire Williams and entered a plea to assault and battery and was fined $1,00 and costs. In the trial of the case in Circuit court Attorney Reed for Maxwell pleaded former jeopardy. but the records in the justice court did not support this contention and Judge Pentecost instructed the jury to disregard it. Prosecutor Dilts and Deputy Hurley appeared for the state. The jurors were: Chas. Laramore. foreman, Wm. Kriss, W. P. Castleman. E. E. Foote, David Dipert, August Barbknecht, C. Beers, H. Lainhart, Julius C. Shultz, W. S. Terry, Thos.
