( i\il Suit Filed In ilan's DeathSALT IAKE CITY (UPI) —The brother of a Salt lake Cityman shot to death by a former city policeman has filed a$125,000 civil suit against the ex-officer and his companion during the incident last fall.Joe M. Herrera sued Richard K. Childs, who was fired from the police department after he fatally shot Joe Oliver Herrera last Nov. 18, and Steven Peterson, an exreserve officer who was with fluids at the tune.Joe Oliver Herrera’s widow and children previously filed a $650,000 civil suit against the former policeman, who fired the fatal shot during an altercation on the sidewalkoutside downtown restaurant. No criminal charges were filed in the incident.The lawsuit asked fo? $75,000 general damages from Childs on grounds he threatened and assaulted the plaintiff by firing bullets at him with intent to harm him.Joe M. Herrera sued Peterson for $25,000 general damages and $25,000 punitive damages on grounds he was threatened and assaulted with the defendant’s “fists and feet.”Childs said he fired the fatal shots after the victim pulled a knife on him during a sidewalkscuffle,
