♦Federal Case May Determine Future PolicyWill Negro undergraduate students be allowed to attend state-supported colleges in Texas?A suit filed this week against Texas Western College on behalf of Thelma White, 1954 graduate of Douglass High School of El Paso, may provide the answer to that question.The suit was filed in U. S. District Court Wednesday. It charged that Miss White, because of the policy of the State of Texas andthe Board of Regents of the University of Texas, is deprived of equal rights under the Constitution.iMiss White presented herself for admission to. the college last September, seeking to major in psychology: She was advised by TWO officials that because of State law she could not be admitted. She then enrolled at New Mexico A. M., where she is now a student.TWC President A. A. Smith was out of town when the Prospector went to press and therefore unavailable for comment.Registrar John M. Whitaker said that he had not seen the petition and could not comment on the action.According to the petition, Miss White was denied admission to the college “because of her race and color, contrarary to and in violation of the Constitution and laws of the U. S.” The suit attacks the Texas public school policy and asks for a final judgment that Texas school laws be held unconstitutional. *■The case will be heard by a three-judge federal court. The judges will be selected by the chief justice of the Fifth Court of Civil Appeals, at New Orleans. Federal Judge R. E. Thomason of El Pasowill be one of the judges.PONDER SERIOUSLY ILLJ.
