*AF officer dismissed from service... Military panel convicts her of adultery, fraternizationLITTLE ROCK AIR FORCE BASE (AP) — After finding 2nd Lt. Naomi Have guilty of two counts of adultery ana one count of fraternization, a 10-member military iury has sentenced her to dismissal from the Air Force and forfeiture of all pay and benefits.After the convictions were announced, military judge Lt. Col. J. Jeremiah Mahoney set aside theadultery charge regarding one of theaffairs, saying it would be redundant to convict Mrs. Haye of adultery and fraternization for the same conduct with one man. Mahoney said last week while hearing pretrial motions that he would take this action should the jury convict Mrs. Haye on all three counts.The jury deliberated more than six hours Monday before deciding she was guilty of the charges, ana then retired again at 5:30 p.m. to decide on sentencing. Those deliberations ended just before 10 p.m.The verdict and sentence will be automatically appealed to a military court in Washington. Mrs. Haye could have been sentenced to asmuch as three years’ imprisonment.Mrs. Have was not available for comment Monday after either the verdict or sentence was announced. But her civilian attorney, Morgan “Chip” Welch of North Little Rock, said she had given him a message toconvey.That message, he said, is that “if you are a female officer on a Titan missile crew, you should consider getting out now, because to do otherwise leaves you open to sexual harassment and ultimate prosecution if you don’t put out.”The charges on which she was convicted accused Mrs. Haye, 29, of New York, of adultery last year with Capt. Robert J. Burns, 28, and of adultery and fraternization with T-Sgt. Thomas Bush, 32, in January and February of this year. Both men are married.The charge of fraternization — a friendly relationship between an officer and an enlisted person, detrimental to military order and discipline — arose from the adultery chargeThe three all served with the 308thStrategic Missile Wing at Little Rock Air Force Base. The wing providescrews for Titan 2 nuclear missile silos in Arkansas, which are now being dismantled.Welch said Monday that Mrs. Haye was the target of an Air Force witch hunt. He argued that Mrs. Haye was being prosecuted as the result of discrimination stemming from the fact that she is a white female officer married to a black enlisted man.“I think the prosecution has been unequal in its treatment of my client as opposed to the male members,” Welch said earlier in the trial. Burnsaccepted non-judicial punishment of an $800 fine after admitting to the affair, while Bush has not been charged pending the outcome of Mrs. Have’s court-martial.welch has said his client declined to accept administrative punishment for the adultery charge involving Burns because that option was not also offered for the other two charges involving Bush.The iury was comprised of two officers from Altus AFB in Oklahoma, one officer from Dvess AFB in Texas, six members of the 314th Tactical Airlift Wing at LRAFB and a staff member of the LRAFB hospital.In testimony Saturday, Mrs. Haye admitted having an affair with Burns but denied any such relationship with Bush. She also rebutted testimony from Bush that he had followed her to a clinic where she had an abortion performed. No such operation occurred, she said.Last week Bush testified that he and Mrs. Have had a sexual encounter while Doth were assigned toa missile silo, and that they also engaged in sex at a motel where she registered under an assumed name.Mrs. Haye did testify, though, that she had engaged in sex with Burns at a park in North Little Rock, and at a motel.The defense counsel provided by the Air Force for Mrs. Haye, Capt. Thomas Murray, said Saturday that the defense contends that an off-base sexual affair between consenting officers doesn’t violate the Uniform Code of Military Justice.“I think the prosecution has been terribly unfair, Welch said. “I think the prosecution has been vindictive.”
