Concerning all the coal that underlies the southeast quarter of fractional section number 20 in Lawrence township in said Stark county, containing 103 33-100 acres ofland, more or less, on which Peter Walters resided at the time of his 'dedth and for manv years before, and being or intended U) be all that part that I now own of the land that was conveyed to my now deceased wife, Sarah E. Harsh, and myself by the heirs of Stephen Cooper, of York county, Pa., by deed recorded in the records of deeds of said Stark county, volume 31, pages 497-498, to whieh reference is here made, all of such coal except that which underlies so much of said land as lakes in the land on which the buildings now on the premises stand, so that they may continued to stand unaffected by mining operations, I hereby give, bequeath and devise to the ehil-an drew of my granddaughter, Fanny U. Pierce, above named, and to their heirs and assigns forever, together with the full and unrestricted privilege and right to mine out and remove the same, or to have it done, and all rights, interests and estate of mine in and under the certain agreement respecting coal under said premises entered into by and between the Drake Coal Company and myself, dated June 15th, 1S94, and recorded in the records of leases of said county, voiume 6, pages 203-264, to which reference is also here made, and all the proceeds, income, royalties or rents received, or receivable, from or on account of ijuch coal. And should it become desirable to make any other contract respecting said coal during the minority of said children, or any of them, any duly appointed guardian or guardians of theirs are hereby empowered and direct- i: ed to make the same, with or without b the sanction or approval of the court, as t they may elect.
