(AWThe U. S. Fourth Circuit Court of Appeals today heard attorneys for DavisFrozen Foods, Inc., ask for reversal of the Raleigh, N. C., Federal District Court, where the Norfolk Southern Railway Co. last fall won a judgment against the Davis ‘firm for $26,250 as the result of a freight train derailment.Counsel for the Davis company argued that the trial judge erred in . directing the jury that the Davis company caused the derailment when one of its trucks struckalignment.At the very least, they argued,the railroad was guilty of contributory negligence in failing adequately to mark the low underpass at the trestle and in failing to stop the approaching train after members of the crew had spotted theshifted rails.Counsel for the railroad arguedthat the line had taken every reasonable precaution against the accident and told the court that all the contentions of the defendant had been fairly dealt with during the trial.
