That ticket, he said, was dated Aug. 26, a day Gallegos was in Albuquerque, Riggs said.Detective Belarmino Lopez testified Wednesday that the tire prints were faint to begin with and the plaster mix he used was too watery, ruining the results.Riggs claimed Gallegos could not have committed the murder. He said medical experts have fixed the time of Gutierrez’s death between 24 and 36 hours before her body was found on the morning of Aug. 27, 1994. This would mean she was killed between the late afternoon of Aug. 25 and the morning of Aug. 26.However, Riggs said, Gallegos was seen by several people in Albuquerque beginning on the afternoon of Aug. 25 and about 11 p.m. that night was arrested for drunken driving by Albuquerque police.Riggs said it had rained the night of Aug. 25 and the morning of Aug. 26, but that Gutierrez’s body had not been rained on.However, Lopez testified the ground around the crime scene was dry and this accounts for the faint tire print. The weather report in The New Mexican shows no precipitation during the entire five days before Gutierrez’s body was found. The National Weather Service shows that one reporting station in Santa Fe showed .18 inches of precipitation on Aug. 26.Among those testifying Wednesday was Gutierrez’s 8-year-old son Michael, who said he was at his grandmother’s house when he saw his mother drive up with Gallegos and a man he knew as Arthur. The boy said he asked his mother if he could go with her. She told him no. It was Michael’s first day of second grade.Gutierrez’s mother, Eleanor Gutierrez, testified that she had once been on friendly terms with Gallegos, who dated her daughter since 1993.She said both were recovering heroin addicts and Gallegos had started a Narcotics Anonymous chapter at Highlands University, where he was a student. However, things began to change in the spring of 1994, after Lisa’s brother died in a carwreck, Eleanor Gutierrez said. Her daughter began using heroin again, she said. Gallegos became possessive and obsessively jealous of her daughter, she said. “I was hoping she wouldn’t go with him,” she said of that last time she saw Lisa, Aug. 22.A secretary at St. Vincent Hospital testified Wednesday that Lisa Gutierrez came to the hospital on the morning of Aug. 24 complaining of headaches, dizziness and depression. Gutierrez wanted to see her physical therapist, who was not at work, Bonnie Trujillo testified.CORRECTIONSThe New Mexican will correct factual errors in its news stories.
