AN ORDINANCEAN ORDINANCE authorizing a contract with the Standard I.atM tk Improve-ment company for the use ami final ownership of its sewers to territory pro. posed to be annexed to the Jtorough, lt;JL reeling its provisions and providing for the payment of rentals.WHEREAS a petition has been presented to the Burgess and Town Council of the Borough oj Monessen, by a majority of the free hold owners of ots or outlets of a section of land lying in Rostniv^r Township, Westmoreland county, Pennsylvania, adjacent to the Borough of Monessen, praying for the admission ami annexation thereof as a part of said Borough; andWHEREAS the Standard Land Improvement company, a corporation of Pittsburg, one of the petitioner?, »»d principal owner of the terrilorv dcsliwl to be annex- d, has heretofore cotiBtnif'P*d and is now maintaining a system of sewers, conduits and pipes, with the necessary inlets and appliances, for surface and under-surface and sewer drainage within said territory and if said territory he annexed to said Borough, it is desirable that the Borough of Monessen should finally Own the same for stiver purposes in connection with its present sewer sy-tem, and to such eud.it iseqqitythat said Standard Land Improvement coin pan y should be partially reimbursed for its out-lays in the premises.THEREFORE, BE IT ORDAINED AND ENACTED by the Chief Burgess and Town council of the Borough of Monessen, and it is hereby ordained and enacted by the a- tbority of the same.SECTION r. That the Chief Burgess, President of Council and Borough Clerk be and they are hereby authorized and directed to enter into a contract with the Standard Land Improvement company for the use of the sewer system aforesaid, for a period or term of five years from such time as the territory aforesaid shall be finally annexed to said Borough at and for the sum of Seventeen Ktrt’dted 1*1700 ou) Dollars per year, payable at the end of each year.SECTION2. That said contract shall contain a provision that upon the payment of the fifth and final installment of rent aforesaid, said Standard Land dc Improvement company shall deliver the said sewer system to the Borough free and discharged of all claims and encumbrances, and to that end shall make, ex-cute and deliver such instruments of writing as may be deemed requisite.SECTION 3, That said contracts shall also contain a provision, that it shall have no binding force upon either party thereto, if the annexation of Ihe territory aforesaid be finally defeated.SECTION 4. That the annual rentals aforesaid shall be paid frctn the current revenues of the Borough.Ordained and enacted in Ccuncil this Tenth day of November, A D. 1904,H.
