Bate* receives 10-year sentenceDewey Lockwood Bates Jr., 20, 1305 S. Plate St., has been sentenced to serve 10 years with the Indiana Department of Correction following his conviction on a charge of voluntary manslaughter.Bates originally was charged with murder in the Nov. 15,1079, shotgun slaying of his second cousin, William Edward Fallen, 21, 1424 S. Plate St.He pleaded guilty to the lesser offense of voluntary manslaughter under the terms of a plea-bargain which provided that he would serve a 10-year prison sentence.A murder conviction carries an imprisonment penalty of between 30 and 00 years.Bates’s case originated In Howard Superior Court 1, but he was sentenced by Carl Van D m, the regular judge of Howard Superior Court 2 who served as special judge in the matter.information already presented in the case indicated that Fallen, upset at some other people, came to Bates's apartment Nov. is and demanded a gun to shoot them.Bates refused to give him a gun and Fallen argued with him and others in the apartment for about 30 minutes. Bates went to an upstairs room and got a sawed-off .12 gauge shotgun. When Fallen followed up the stairs and advanced toward Bates, the defendant fired once, shooting Fallen In the chest from a distance of two to three feet, police said.The defense contended earlier that the shooting was in self-defense.
