A CAKE-WALK COMPETITION.Wallis and another v. Galanzi and another.— In this case Messrs. Wallis and Down, entertainment proprietors, sued Messrs. Galanzi and Sherek, carrying on business as International variety agents, torecover damages for alleged breach of contract. Defendants denied liability.Mr. Lampard appeared for the Plaintiffs, while Mr. Cannot represented the Defendants.I t appeared that in August of last year the Defendants were in possession of the circus buildin in the Western Cardens, Earl’s-court Exhibition, “and Plaintiffs were desirous of obtaining the building inorder to give an entertainment known as the cake-walk competition. Qn August 5 an agreement was signed between the Plaintiffs and Defendants, under which the former said they were to have the use of the building at least twice a week for the purposes of their entertainment during the remainder of the season. Plaintiffs said, after they had made preparations for the production of the entertainment, the Defendants failed to let them have the use of the hall, and the result was they had sustained a considerable loss. Defendants said the use of the buildiiig for the cake-walk competition was subject to the granting of a licence by the Earl’s-court Exhibition authorities, and, as that licence was not obtained, the Plaintiff's were not entitled to the use of the building.Mr. Justice Darling, in summing up the case to the Jury, said one American entertainment succeeded another in this country.
