Caves To Ignore Subpoena If Negro Church Is UsedJones County Circuit Clerk Leonard Caves said Saturday he will ignore a subpoena in which he has been summoned to appear at St. Paul’s Methodist Church, 717 Jefferson St. Feb. 9 for questioning by lawyers for the Freedom Democratic Party.But Caves will respond to the subpoena if the questioning is held in the courthouse or federal building here, he said.“It is ridiculous to be summoned to a church for questioning when we have two courtrooms in the courthouse here and also a federal building, Caves said. “I’ll not go to the church but will appear if the hearing is held in a proper place.Under federal law, Caves canhe fined *20 if he fails to anrtoar| or be indicted for a misdemeanorand imprisoned if convicted.The Freedom Democratic Party is seeking to unseat members of Mississippi’s congressional delegation. It is charged Mississippi congressmen were not legally elected because Negroes were systematically barred in attempting to register as voters.Primarily, the Freedom Democratic Party is made up of Negroes. But white lawyers from other states are pushing the drive to unseat Mississippi congressmen. St. Paul’s Methodist Church is a Negro church.The subpoena was served on Caves Friday afternoon. It bore the signature of I. L. Thomas,Laurel Negro dentist and a notary Dublic.
