It is thereupon, this 10th day of January, in the year one thousand nine hundred ana eight, ordered, by the Circuit court of Baltimore city, that the plaintiffs give notice by publication of a copy of this order.once a week for four successive weeks, before the 10th day of February. 1908. In some daily newspaper published iu the city of Baltimore, of the substance and oblect of said bill, and warning the following non-resident defendants to appear in this court, in person or by solicitor, on or before the 20th day of February, 1908, and show cause if any they have why the relief prayed for should not be granted, to wit:Julia de Gatio Chartters. widow: Susan Margaret Chancellor. Vespasian Chancellor. her husband: Mary Edward Frazier, widow: Clifton Bailey, Zebe Frazier Bailey, his wife: Margaret Bailey Coleman. William Coleman, her husband: Florence B. Solon,periuu ui muio luuu wwactual, visible, distinct and exclusive possession of the bed of said court or alley, which possession has been hostile and adverse to the parties above named, but under a claim of right by the plaintiffs to hold said court in fee-simple, free from the rights of any other parties. That during said time the plaintiffs and their predecessors in title have enclosed the said court by a gate and have U9ed the same for the storage of boxes, goods and other material, and both before and after the great Qre of February, 1904, bave hadvconstructed upon a portion of said oourt apportion of their warehouses, and Xia.ve likewise paid thetaxes on the satd property, which taxeswere assessed to/Emanuel Greenbaum, and that by such acts of ownership the plaintiffs acquired a fee-simple title there, aud that any outstanding title has since been barred and lost.That after the flre in 1904, the Mayor and Citv Council of Baltimore, through the Burnt District Commission, condemned a portion of said court for the widening of German street, but declined to pay the amount awarded for the said portion to Emanuel Greenbailm, and filed its bill of complaint in the Circuit Court of Baltimore City, in the case of the Mayor and City council of Baltimore vs. Charles W. Chancellor et al., wherein all the parties having any interest, legally or otherwise, in said property were made part3r defendants, and wherein it was alleged that in view of the reasonable doubt which the complainant entertained concerning the ownership of the property condemned and the manner in which the award should be divided, and of the conflicting claims made in reference thereto, it could not reasonably or safely pay the sum awarded, and accordingly thesaid amount was paid into court.That by the action of the Mayor and Council of Baltimore, as above recited, the action of the parties to the above proceeding in claiming the fund so paid into court, a cloud has been cast upon the title of the plaintiffs in and to the ing portion of the said court ornotwithstanding their longadverse possession, as also the to that portion of the large andwarehouses erected on a portion of court, and that a future sale of the plaintiffs’ property would be interfered with until the interest, and rights of the parties are adjudicated. That the are now, and have been, in bed of said court or alley, su to the use of a portion above recited, by the Johns Hospital, and consequently are remedy at law to remove the cloud, or to have the said claims adjudicated, and for the protecting their possession, and harrased by suits in regard to they have been advised that they are entitled to file in a court of equity, their bill for the removal of said cloud, am} the adjustment of said conflicting interests, if anythere be, p ^ . .__.The bill then prays that the defendantsbe required to answer the same and that a decree may be passed removing the said cloucLfrom the plaintiffs’ title and confirming the same and establishing the title free, clear and discharged from any and all interest and estate of tOe defendants in thisC86. •' • ' ; .. .Also lor such other and further relief as their case may require.Rawlings, her husband; Mary Lelia Thorn ton Henry A.
