She said some of the injuries were a result of the fact thatthe woman struggledagainst her attacker.The victim, 37, was visiting a relative in the 1000 block of Oakwood, and when she left the building just after 2 a.m., she was confronted by Shelby in a parking area outside.He demanded she come with him, and she refused, so he forcibly dragged her into his nearby home.While there, he committed the assaults, but the victim got away and ran to her relative’s home.“The victim came to the relative’s house, hysterical and bleeding. Police responded, and she was taken to Alton Memorial Hospital. She was given a rape kit and was treated for abrasions to her head, neck and genital area,” Gabriel said.The victim and Shelbyare known to each other, and she identified him as the attacker.Police interviewed him, and he denied he had anything to do with the victim on the night of the crime. However, an Alton Police Department detective found her sunglasses in Shelby’s home, and an analysis showed Shelby’s DNA on the victim’s body,Gabriel said the victim was brave in standing upand being willing to testify-“However, she is greatly relieved that she doesn’t have to come to court,” the prosecutor said.Gabriel also praised Alton police work in the case. The interview and the discovery of the sunglasses were key elements in making a strong case for the prosecution, Gabriel said.Shelby pleaded guiltyto one count of aggravated criminal sexual assault, in exchange for a prosecution agreement to drop two of the aggravated criminal sexual assault charges and a count of unlawful restraint.Shelby has no prior felonies on his record.
