He further characterized 'ihe decision as being made “without giving both parties the chance to appear and plead their case and placing them at the mercy of a judge sitting in another county who would not even hear them.Mayor Kowalski advised the council that the law states that the names of the candidates not nominated by any party should be printed in the “independent column, but he was corrected by Alderman Crixell, who stated that the law said they should be in the “independent columns. Whereupon City Attorney Russel advised that it should be either “independent or non-partisan columns.A. B. Cole, the Independent nominee for mayor, who was present, sta’ed that it was idle to discuss the matter further as to whether the injunction was right or wrong, as they would have to abide by it, which closed the argument.The following is the injunction as filed with the committee’s report:The State of Texas:To Benjamin Kowalski, Mayor of the City Brownsville, Texas, L. B. Puente, City Secretary of said City of Brownsville. C H Hnre W Swho have not received the endorsement of such Independent Club or Party.You and each of you, your counselors, solicitors, agents, servants and employees are further commanded to desist and refrain from failing and refusing to prepare, print, distribute and cause to be used at said election the official ballot and form as required by law, and that you and each of you do forthwith so prepare an 1 cause to be printed, distributed and used at each and all of thepolling places in said City of %Brownsville at said election on April, 2, 1912, and as the only official ballot so 'to be used at such an election, the following form of official ballot, as required by law, namely, a ballot containing two columns, only in one of which shall be placed the names of all the nominees of the Democratic Party for the offices to be filled at said election, each opposite the office for which he is a candidate, the said column carrying at its head the party name, to-wit:Democratic Column.For Mayor, I*uis Cobolini.For City Secretary, Adolfo Pec in a.For City Attorney, T.
