The following decision of the attorney general of Michigan was made in response to inquiries As to the construction to be put upon the constitutional amendment a relative to the qualifications of electors which was adopted last fall. The decision is published by the Secretary of state for the Benefit of whom it May concern a previous to the last general election by Section 1 article t of the Constitution of this Sute in All elections every male inhabitant who had resided in this state two years and six months and who had declared his intention to become a citizen of the United Sites pursuant to the Laws thereof six months preceding an election was an elector and entitled to vote provided. Of course he was above the age of Twenty one years and had resided in the township or Ward in which he offered to vote ten Days preceding such election. This Section was amended at the last general election so that it now reads As follows a every male inhabitant of foreign with who having resided in this state two years and six months prior to the 8th Day of november 1824, and having Deel red his intention to become a citizen of the United states two years and Aix months prior to the said last named Day shall be an elector and entitled to the Section was also amended by requiring that no one shall be an elector or entitled to vote at any election unless he shall have resided in this state six months., and in you by if ure the township or Ward in which he offers to vote a of some dreadful thing has happened Twenty Days next preceding such election. The question is asked a musts foreigner Leeome a full american citizen before he can vote in this Sute a and second a if so docs this affect male inhabitants of foreign i birth who before this Section was amended May have been electors a in other words Are any foreigners by this Section As amended disfranchised my answer to this question to this no male inhabitant of foreign birth now residing in this state can vote at any election held in this state until he shall become a citizen of the United states and a male inhabitant of foreign birth who May have been a qualified elector last november cannot vote next Spring unless he shall be by that time a citizen of the United Sites provide of course that he does not come within Tho express constitutional exception Viz a Rosi Denic of two Yoars and sly months prior to the 8th Day of november 18w. And his having made a declaration of his intention to become a Cut zen of the United state two years and six months prior to said last named Date. In such a Case of course such an inhabitant of foreign birth can continue to vote before this amendment All that was required of a foreigner who came to this state a was a residence therein of two years and a half and a declaration of his intention to become a a citizen of the United states six months preceding an election so that for example Eny foreigner who has come to this state to live two years and six months preceding the last general election in november and had do cleared his intention of becoming a citizen six months preceding said election Becam thereby a qualified elector but now by reason of the amendment All Thia is changed and such a person is no longer an electors he can no longer vote nor can Uny other foreigner vote in this state who has not declared his intention to become a citizen of the United states years and six months preyed Long Tho 8th Day of november 18i,4 it by no Means follows that he is permanently he Sinif Lily must wait until he becomes a citizen of the United states and then to Caa again vote. As is Well known a foreigner can become a full american citizen other conditions being complied with by actually residing within Tho United Statos at least five years. This amendment is As simple and Clear As possible it simply establishes As the constitutional condition precedent to the enjoyment of the elective franchise that a foreign born inhabitant shall wait until he becomes a full american citizen before he shall be allowed the privileged voting in this state. Whilo Many seem to understand this and have no difficulty in reaching this conclusion they inquire a is it possible that this amendment Caa be made to relate Back and compel male inhabitants of foreign Birt i who have once voted in this state to give up that privilege and no vote again until they become full american citizens a is not this in the nature of an sex Post Facto or retroactive Law a my answer is there Are no limitations upon the Power of the people to Amend or revise their Constitution in any Way or at anytime they so determine except As that Power is limited by the Constitution of the United states the people of the state have the absolute Legal right to determine for themselves Tho qualifications of electors and to determine what they shall place in their organic Law. The Rule is settled that the people when called upon to vote upon a proposed amendment to their Constitution Are not obliged like legislative bodies to look carefully to Tho preservation of vested rights they have the absolute Power to determine what Prinell to Are Best calculated to produce Good government to promote to he Public welfare and to secure the safety of the state. Dot there a nothing in the shape of vested rights secured by constitutional enactment relative to the elective franchise. Participation in the elective franchise is a privilege rather than a right and it i granted or denied on the grounds of Public policy.
