Garcia a key figure in the federal case against New Mexico Treasurer Robert Vigil and his predecessor was stripped of his state insurance license six years ago after plead ing guilty to embezzling funds from an elderly client state records show Although Garcia lost his insuranceagent license in 1999 he continued to make political contributions apparently listing himself as being in the insurance Business as recently as this year In a report filed with the New Mexico secretary of states office Vigil this year reported he got a campaign dona tion from Garcia The treasurer listed Garcias occupation as In 2003 Garcia donated to Vigils campaign state records show but was listed only as a In April 1999 Garcia pleaded guilty to embezzlement a fourthdegree felony in state district court in Albuquerque in connection with his insurance business State records say Garcia took from an 86yearold cli ent in 1996 He told the woman he had used her money to buy an annuity and gave her an insurance policy However a year later when the womans niece called the insurance company listed on the policy she learned the policy was in another persons name and the company had never heard of Garcias client Confronted by his client Garcia told her he had taken her money and put it in his bank account according to state records Sam Thompson spokes for the New Mexico attorney generals office said late Friday that she was unable to find records immediately reflecting what received in the 1999 criminal case Termsof the plea agreement stated prosecutors would rec ommend a suspended sentence and 18 months probation After the plea Garcia entered into an agreement with the New Mexico Superintendent of Insurance in June 1999 to sur render his state insuranceagent In the state securitiesfraud charges now pending against Garcia investigators have said Garcia targeted senior citizens The state Public Regulation Commission lists Garcia as one of the organizers and the regis tered agent for American Finan cial Group The stated purpose of the business is to sell policies of Joe J Ruiz deputy state super intendent of insurance said this week that records show Garcia hasnt held a state insurance license since the 1999 revoca tion Art attempt to reach Garcias lawyer Hank Farrah for com ment Friday was unsuccessful Garcia is expected to be a wit ness in criminal prosecutions concerning the state Treasurers Office Garcia faces up to 20 years in federal prison after pleading guilty early this sum mer to aiding and abetting extortion in connection with the federal probe However no sen tencing date has been set and his plea agreement requires that Garcia cooperate with investiga tors In a statement to prosecutors California investment adviser Kent Nelson said he paid Garcia million Nelson who pleaded guilty to mail fraud said he understood that Garcia had contacts with state Treasurer Vigil and former treasurer Michael Montoya and said he understood the payments were necessary for him to continue to receive state contracts Sam Bregman Vigils lawyer told The Associated Press last week that the pleas Garcia and Nelson have entered show fhe governments main in Rio Rancho and Belen was ever built Promissory notes to the victims were never repaid according to the state Securi ties Division The Santa Fe site is located south of Airport Road just out side city limits The property remains vacant even though the citycounty Extraterrito rial Zoning Authority in 2002 approved a development per mit David Abeyta of Albuquer que chief developer for the Santa Fe project said Garcia and Orlando Montoya brother of the former state treasurer previously had raised money for a similarly named project at Los Lunas the Paseo de San Clemente Townhouse project They apparently couldnt pay the debt in Los Lunas so they wrote up some bogus promissory notes and attached them to San Clemente Apart ments in Santa Abeyta said Abeyta said Garcia had sug gested the name for the Santa Fe project and Abeyta said he went along with it Then he said Garcia sought state financ ing for the Santa Fe complex as an affordablehousing project Through Garcias politi cal connections with the state Treasurers Office he was helping us to get State Board of Finance housing Abeyta said But before the state board acted on the financing request Abeyta said he learned of legal questions surrounding Garcias activities Once we discovered he was involved in illegal problems our attorney sent him a letter and said we would no longer be needing his services and we would not be paying any fees he submitted to us on what he was claiming to be investors that he had for that Abeyta said Abeyta said because Garcia had put up some money for the initial option on the Santa Fe land his son Vincent Garcia was allowed to stay on as a minority partner in the project until it was sold to another partnership The San Clemente Apart ments project got rolling in late 2000 when Abeyta registered as sole organizer and director of San Clemente Apartments LLC The following year San Clemente Apartments project Alexander New Mexican Abeyta filed a development permit application with the Santa Fe County LandUse Department In 2002 the Extra territorial Zoning Authority approved the application sub ject to conditions The application says the project was to be a million twostory complex with 44 units and a daycare center on acres The site is between Airport Road and Jaguar Drive south of Sweeney Elementary School along Lucia Lane The property was listed on the application as being originally among the lands of Aivaro Z The real estate was quitclaimed in 1995 by land speculator Richard P Dickie Montoya who died last month to his children Charlotte Capling and Richard A Montoya Santa Fe County Assessor records show the land then was acquired by Walter and Gloria Gould who sold it to Abeytas Juniper Hill LLC Joe Catanach county land use director said the last discussion he had about the project was with local real estate agent Joe Ortiz who apparently was in the process of buying the property or had purchased the property in order that he was going to fol low up and do the County assessor records indi cate the property appraised at for tax purposes was acquired in July 2004 by Raven Ridge LLC The sole organizer of the firm Ortiz who is with Realty City Realty in Santa Fe was not available for comment Friday Investigators said Garcia through his companies Ameri can Financial Group and MAV Investments had targeted senior citizens through news paper ads and mailings Garcia last pleaded not guilty in state district court in Albuquerque to charges that his attorney said primarily involve securities fraud Contact Tom Sharps at 9953813 or Once we
